When pilots are arrested, there’s more at stake than just criminal charges
Is it possible for a pilot to be charged with a DUI while flying? Yes. According to Federal Law, no person may perform the duties of a crew member or pilot an aircraft:
- While under the influence of alcohol;
- After consuming any alcoholic beverage within 8 hours of flying;
- After using any drug that affects the person's abilities for safety; or
- Having a blood-alcohol concentration (BAC) of 0.04 or greater.
The federal penalties for flying under the influence can be quite severe, with prison sentences up to 15 years and suspension or revocation of a pilot’s license or FAA certificate.
If a pilot is found guilty of Flying Under the Influence (FUI) in California, not only do they have possible federal issues to overcome but potentially state penalties as well. For example, under California Law, It is illegal for any person to:
- Operate an aircraft while under the influence of alcohol or any drug, or the combination of drugs and alcohol;
- Operate an aircraft with a blood-alcohol concentration (BAC) of 0.04 percent or more; or
- Operate an aircraft in a careless or reckless manner that may endanger the life or property of another person.
A first-offense conviction for flying under the influence may include up to 30 days of jail and a fine of up to $1,000. Additionally, the court may prohibit a convicted pilot from operating an aircraft within the State of California for up to one year as an added penalty.Do I Need an Airport Arrest Attorney?
