In 2016, postal service inspectors seized over 37,000 pounds of drugs (the majority of which were marijuana) with an estimated value of 23.5 million dollars. What does the law say about Cannabis and other drugs in the mail?

  • Under Federal Law, Marijuana is a schedule 1 drug.
  • The United States Postal Service is tasked with filtering through mail to locate restricted items.
  • The United Stated Postal Service is a Federal Agency, and as such, recognized Federal law.
  • Depending on the quantity and type of drugs mailed, you may face drug trafficking charges.

Under CA Health and Safety Code 11379, anyone who:

  • Transports for sale

  • Administers
  • Gives away
  • Offers to transport
  • Imports into the state
  • Attempts to transport

Under 21 U.S. Code § 841, it is unlawfull for anyone to  knowingly or intentionally

  • Possess with intent to distribute

… any controlled or counterfeit substance

Can I mail prescription drugs ?

  • ONLY entities that are registered with the DEA are eligible to send drugs through the mail.
  • There are “mail-back” exceptions if a drug company mails you drugs of the wrong type or quantity, in which case you can mail them back to the pharmaceutical company. Otherwise you may noy mail prescription drugs in the mail.
  • If you mail drugs that you do not have a prescription for, you may be charged with the misuse of a prescription medication.

What are the penalties?

Penalties under State law:

  • Imprisonment for a period not less than two years
  • Higher penalties if a minor is implicated in the transport of a controlled substance.

Penalties under Federal Law:

  • For 5 grams or more of Pure Meth
    • 5-40 years of imprisonment and a maximum of a 5 million dollar fine.
  • For pure meth greater than 50 grams
    • At LEAST 10 years of imprisonment, and up to a 10 Million dollar fine (for first offense).
    • At LEAST 20 years of imprisonment, and up to a 20 Millon dollar fine (for second offense).
    • Other penalties depending on drug type and quantity transported.
